Terms & Conditions


1. Introduction
The following terms and conditions shall constitute the agreement between parties living in countries or regions outside Japan and TiOT, Inc., a Japanese company headquartered at 8-29-2 Kourigaoka Hirakata Osaka 573-0084, JAPAN (hereinafter "Japa Stuff"). Parties interested in purchasing merchandise from Japa Stuff (hereinafter "Members" or "Customers") should understand and agree to the following terms and conditions before placing an order.

2. How to Order, and about Delivery
*For a first-time order, in accordance with our Terms and Conditions we require customers to accurately provide their name and address information before ordering (member registration). Please consult with our "Countries and Regions We Shop To" and "Shipping and Handling Charges" pages for more information regarding service in your area.
*Please choose a password that cannot be easily figured out by a third party. In the event that delivery could not be completed due to an error in the customer's data entry, we will bear no responsibility. If the customer would like to have the order re-shipped to the correct address, then we will ask the customer to pay the actual, full price of the shipping costs.
*There is a spending limit of JPY 200,000 per one single order. (The JPY 200,000 limit is calculated from the merchandise sub-total. Shipping and Handling charges are not included.)
*Even though the item showed in stock at the time it was added to the shopping cart, depen ding on the customer's timing of checkout and payment, the stock may become unavailable, and purchase of the item will not be possible.
*Even after the Order Confirmation mail has been sent, as stock information is not kept in real time, there may be instances where part of all of the order becomes out of stock. Also, our stock information may differ from that of another company's. Please be advised that even if the same item shows in stock at a different company, it may still be unavailable through our website.
*Order contents (such as size, color, or quantity) and the shipping address information cannot be changed once the order has been placed. Orders cannot be cancelled or changed in any way once they have been submitted.
*Although we strive to ship your order within 7 business days from the day it was placed (excluding Saturday, Sunday, holidays, and days in which we are closed for business), depending on the contents of the order, the condition of stocks, and the volume of orders, there may be instances where shipment of the order is delayed. (Custom orders may take additional time for production). Please view our calendar of business days on the lower left-hand side of the top page.
*We ask that customers please investigate the rules and regulations regarding importing into their country, including goods restricted for import, before placing an order. In the unlikely event that an ordered item is not allowed for import into the customer's country, we cannot accept responsibility for the item. We cannot provide any refunds or exchanges to the customer for the item or cost of delivery.
*We reserve the right to combine multiple orders from the same customer, and ship them together as one unit.
*Orders to countries and regions other than Hong Kong will be sent by Express Mail Service (EMS). Orders to Hong Kong will generally be sent by international couriers DHL and Overseas Courier Service (OCS). However, depending on the contents of the order EMS may also be used.

3. Shipping and Handling Charges
*Shipping and handling charges are set based on the total amount of ordered merchandise and those charges include the Express Mail Service (EMS) or international courier (DHL/OCS) postage and insurance fees, etc. They should be paid together with the total amount of the ordered merchandise.
*In the event that a customer refuses to accept the delivery of an order, or if an order is returned to us after the retention period at the post office has passed after failed delivery attempts, we cannot provide a refund for the shipping and handling costs. Additionally, we will subtract the actual amount of the Express Mail Service (EMS) or international courier (DHL/OCS) shipping costs from the item subtotal before making a refund.

4. Payment
*The amount charged to the customer will be the total sum of the merchandise plus the shipping charges.
*We accept payment by PayPal. Fore more details regarding payment, please contact PayPal directly.
*Settlements will be made in Japanese Yen

5. Customs duties and export certificates *Orders may be subject to import tax, value tax, customs handling fees, and/or delivery fees in some countries or regions. In this case, the Customer (or the recipient if the merchandise is not shipped to the Customer) should be responsible for the payment of for any such taxes or fees.
*In the event that the delivery of an order is delayed due to trouble or processing at customs, we bear no responsibility for this situation.
*We do not issue any proof of export documents, such as proof of country of origin, or export visas.

6. Returns and Exchanges *To be eligible to return and/or exchange merchandise, customers must contact Japa Stuff with information regarding the items you wish to return within 14 days of receipt of shipment by e-mail. We will only accept returns of items that we have confirmed for return. Please ship the confirmed return items back to us within 7 days.
*We will not accept a request for a return and/or exchange if customers contact us after the 14-day period is over, or returns the merchandise to us without prior notice.

    1. In the case of "Circumstances arising with Japa Stuff", we will accept the return from the customer if:
    (a) The merchandise is different from what the customer ordered (wrong shipment).
    (b)The merchandise is defective.
    (c)The merchandise is damaged.
    We will reimburse the customer for shipping costs incurred.
    * In the event of a return of set merchandise (ex. 2-Piece Set, or an Ensemble), please include all items in the set in the condition that it was delivered in when making the return. If even 1 item is missing from the set (or, an included item or accessory), we will not be able to process your return.
    2. In the case of returns "At the Convenience of the Customer"
    If the Customer is not satisfied with the items (not satisfied with the color or print, the size does not fit, etc.), the Customer is responsible for all shipping costs incurred.
    * We do not accept returns in the following cases:
    (a) Customer has not informed Japa Stuff about returns/exchanges within 14 days after the receipt of the merchandise
    (b) Items that have been used or worn once or more
    (c) Cosmetics and health foods where the package has been opened
    (d) Merchandise without the original case or package
    (e) Merchandise that has been adjusted or cleaned by the Customer.
    (f) Merchandise that has been soiled or damaged by the Customer (cosmetics, fragrance, smells included)
    (g) Merchandise where the tags have been removed by the Customer
    (h) Merchandise where the shape has been changed by the trial fitting (ex. a stretched neck line or cuffs)
    (i) Sale items
    (j) Food
    (k) Custom-made merchandise
    3. Exchanges in the case of "Circumstances Arising with Japa Stuff":
    (a) The merchandise is different from what the customer ordered (wrong shipment).
    (b) The merchandise is defective.
    (c) The merchandise is damaged.
    We will reimburse the customer for shipping costs incurred.
    Please inform us in advance if you wish to make an exchange. If the item(s) to be exchanged are out of stock or have been discontinued, the customer will be given a full refund for the merchandise.
    4. In the case of "At the Convenience of the Customer", exchanges are not accepted.
    If the customer wishes to make an item exchange for any reason (change to a different size, color, or pattern, or exchange unwanted item(s) to other products such as exchanging a T-shirt for a bag), then please return the unwanted item(s), and make a new order for your desired goods. Regarding returns, please follow the procedure outlined in "2" above. As for why exchanges are not possible, this policy was created in mind for our customers - if you make another order after returning your unwanted merchandise, this method helps to reduce the burden of the shipping costs.
    *Merchandise with an approved "Returns and Exchanges" form must be returned by Express Mail Service (EMS) or by airmail. Please do not send your return by surface mail, economy air (SAL), DHL, FedEx, UPS, or any other private international mail carrier. Returns made through any method other than EMS or airmail will not be accepted, and the customer will not receive a refund on the merchandise. *In the case of "Circumstances Arising with Japa Stuff", the customer must pay in advance for shipping charges. Collect/Cash on Delivery (COD) shipments will not be accepted.
    *Upon arrival of the returned merchandise, we will ship the new merchandise. If a letter of approval is not included with the returned item(s), it may take longer to process.
    *The merchandise and/or shipping refund will be made through the PayPal account that was used to purchase the merchandise. In the event of a refund, PayPal exchange rates applied to the amount billed for the merchandise and shipping and handling charges may differ from those at refund. Thus, there may be differences in the total amount refunded due to exchange rate differences. Even if the customer experiences a loss as a result of a different exchange rate at the time of refund, Japa Stuff will not be responsible for this loss. It may take a few days to the maximum of 10 days for the refund to finish processing.

7. Product Safety
Please use common sense and due caution with all purchased products, especially around small children.  All Items sold on Japastuff.com has passed necessary regulations to be sold in Japan.  Japa Stuff is not responsible for customers who are unable to read warnings and instructions of the products purchased through Japastuff.com.  Furthermore, should any problem arise, Japa Stuff will not be responsible for liabilities produced by the items purchased on Japastuff.com. 

8. Other
*Members should immediately login to www.japastuff.com and update personal details if any changes in the registered information with us, such as name and address details, have incurred.
*We have the right to cancel the registration of a Customer at any time if:
(a) The customer does not comply with the Terms and Conditions.
(b) The customer has been a nuisance and caused interference or damage to other customers or Japa Stuff, and/or committed any acts of fraud.
(c)Any other circumstances in which Japa Stuff determines that the customer should be disqualified.
*Japa Stuff will not be responsible for any damages incurred except for those resulting from the purchase contract between the Customer and Japa Stuff.
*Japa Stuff may suspend this mail-order service if an unavoidable situation arises. In this case, the purchase contract already in effect will continue to apply under these terms and conditions.
*Any problems that may arise between Japa Stuff and a Customer in connection with the sale of merchandise should be subject to the jurisdiction of the Osaka Regional Court in Japan under relevant Japanese law.
*We will not use customer information registered pursuant to these terms and conditions for any purposes other than the sale of our merchandise and provision of merchandise information via website and international mail. If a customer requests deletion or change of any part of such information, we will immediately comply with the request.
*Japa Stuff reserves the right to amend the terms and conditions as necessary.
